Personal data
Filming a place means filming people.
A shoot catches faces, licence plates, sometimes minors. This page says how we film while your venue stays open, and what we handle afterwards.
Your venue stays open, and we are the ones who give notice.
You close nothing
We film under normal operating conditions. Your customers and staff stay put, and you move no appointments. Nobody has a form to sign, neither your staff nor your customers.
The notice is ours
During the shoot, an A3 97View notice stands at the entrance. In three languages, including Brazilian Portuguese, it announces the shoot and says what it is for. It names SASU AIS as the data controller and warns that the images will be blurred. Finally, it says how to object. We put it up when we arrive and take it down when we leave. At the start, we also tell your staff in person.
Why nobody signs
Filming relies on the legitimate interest of SASU AIS, under Article 6(1)(f) of the GDPR. Consent would be the wrong basis, because nobody gives it freely in a place open to the public, and anyone could withdraw it once the image is online.
What we ask of you
At scoping, you point out the areas we do not film, for example the back room, an office, the till screen or the storeroom. For the shoot, that is all we expect from you, and nothing requires you to rearrange your venue.
What we blur, and how we check it.
Before any publication, automatic blurring covers identifiable faces and licence plates. Automation lets things through. So an operator reviews every panorama in full, to spot and correct what it missed. The images are published on Google Maps and Street View, where anyone can see them.
A written record of that check is kept for each deliverable, with its date, its operator and its result. It stays with us. It is our proof of compliance, not a document you receive.
The right to object
Anyone filmed can object to their image being published, at any time, by writing to contact@97view.com. We then remove the image, or strengthen the blurring, within 72 working hours. This right does not delay publication, it stays open after it.
We handle delicate cases without asking anything of you.
Minors in shot
In your venue, when minors are in an area, we do not film it, or we do not publish the shots in which they appear. We decide on the spot, and you have no parental permission to gather.
Vulnerable people, sensitive data
A medical practice, a social centre, a nursery or a drop-in crèche receives vulnerable people. A pharmacy or a counter shows sensitive data by its very layout. In these places, we exclude the area concerned from scoping onwards, or we apply stronger treatment in post-production. The choice is ours, and it requires you neither to close nor to send anyone out.
This page describes a practice, not a regime.
The legal bases relied on, the retention periods and the rights of the people concerned live in our GDPR and image rights policy. It is available on request at contact@97view.com.
The site's legal information answers a different question, that of who publishes these pages and how your contact details are handled there.
